Abstract

The development of financial technology in Indonesia has brought about various innovations in payment systems, one of which is digital wallets (e-wallets). The presence of digital wallets provides convenience for the public in transactions, but also creates new risks, including their use in facilitating online gambling transactions. This study aims to analyze the legal liability of digital wallet providers in the context of the rise of online gambling practices in Indonesia, by reviewing them from the perspectives of criminal law, administrative law, and civil law. The research method used is a normative juridical method with empirical support, through a review of laws and regulations, legal doctrine, court decisions, and empirical data from official agency reports and credible news. The results show that criminal liability can be imposed on digital wallet providers if they are proven to actively or intentionally assist online gambling crimes; administrative liability arises when providers neglect to carry out supervisory obligations as stipulated in Bank Indonesia and OJK regulations; while civil liability applies if users or third parties suffer losses due to the service provider's negligence. This study also found a gap between legal norms and practice, particularly regarding limitations in transaction monitoring technology, weak coordination between agencies, and delays in blocking accounts or accounts related to online gambling. Therefore, regulatory strengthening, the implementation of artificial intelligence-based suspicious transaction detection technology, increased sanctions for negligent providers, and synergy between institutions are needed to prevent the misuse of digital wallets for illegal activities. This research is expected to provide academic contributions and practical input for regulators, digital wallet providers, and the public in creating a secure, transparent, and legally compliant digital payment ecosystem.
